University of Hawai’i Settles Data Breach Class Action<\/strong><\/p>\n

The University of Hawai’i has settled a class action data breach lawsuit
\ninvolving five data breaches between 2009 through 2011. The settlement will
\nprovide class members with two (2) years of credit monitoring and fraud
\nrestoration services. The settlement in Gross v. University of Hawaii will impact
\napproximately 98,000 UH students, faculty, alumni, UH employees and others who
\nwere part of the five data breaches. The breaches occurred at University of
\nHawai\u2018i at Manoa, University of Hawai\u2018i at West Oah\u2018u, Kapio\u2019lani Community
\nCollege, and Honolulu Community College.<\/p>\n

\u201cWe have researched more than forty (40) data breaches at colleges and
\nuniversities across the country. In almost every instance, two years of credit
\nmonitoring and fraud restoration was offered to data breach victims,\u201d said Bruce
\nSherman, one of the attorneys representing the class. \u201cOffering two years of credit
\nmonitoring and fraud restoration services to breach victims should be the standard
\nresponse by any breaching entity in Hawai’i, including government agencies,\u201d
\nSherman noted.<\/p>\n

\u201cThe settlement is significant for several reasons,\u201d said Thomas Grande,
\nwho also represents the class. \u201cThis settlement is the first data breach settlement in
\nHawai’i and affects almost 100,000 persons,\u201d Grande noted.<\/p>\n

\u201cCredit monitoring provides for continuous checking by a credit agency of a
\nclass member\u2019s credit file. If there is suspicious activity, the class member is
\nnotified immediately and is given assistance to resolve the problem,\u201d Sherman
\nsaid.<\/p>\n

\u201cCredit monitoring services may cost as much as $5 to $15 per month if
\npurchased individually. We are extremely pleased that the University has<\/p>\n

negotiated a settlement package that provides these services to every class member
\nwho wants them,\u201d Grande said.<\/p>\n

The settlement, which is still subject to court approval, will be administered
\nby Kroll Background America, Inc., a firm specializing in providing credit
\nmonitoring and fraud restoration services. Class members will be sent a letter by
\nMarch 1, 2012 that will allow them to sign up for the credit monitoring services
\nonline. University faculty, students and alumni will also be sent e-mails to inform
\nthem of the credit monitoring services.<\/p>\n
